Black & Jones Proves Police Officer’s Lumbar Surgery is Related to His Work Injury

A client asked Black & Jones to represent him when his employer’s insurance company denied that his need for back surgery was related to a slip-and-fall at work. His doctor had ordered surgery, but would not schedule it due to lack of approval from insurance. He was unable to work due to his back and was not receiving any pay. Bills were accumulating and he was not getting any answers from his employer.

It was clear to us that the insurance company was going to have to be forced to accept the case, approve treatment and pay benefits. In order to prove that his condition was work related, we needed to secure a medical opinion. Black & Jones obtained a copy of the medical records and retained an expert to do an examination and prepare a report which stated clearly that the condition was due to a work-related injury.

After obtaining a medical opinion to support the case, a demand was made on the insurance company to accept the case, pay benefits and approve treatment. While fighting with the insurance company, Black & Jones made sure that the client was aware of all his available options including using his health insurance to get his treatment so that he could feel better as soon as possible. We also were able to assist him in obtaining Public Employee Disability Benefits (PEDA) and, when he could not return to work, line of duty disability pension benefits.

Despite fighting and denying benefits, the workers’ compensation insurance company finally gave in and Black & Jones was able to secure a settlement for the client which helped to compensate him for his lost wages, medical bills and permanent partial disability benefits.
